Attorney fees

 

Attorney fees are regulated in The Decree of the Ministry of Justice No. 177/1996 Coll., on Remuneration and Reimbursement of Lawyers for the provision of Legal Services (Barrister's Tariff) as amended by Decree No. 235/1997 Coll

The mentioned decree differentiates between contractual fee and non-contractual fee. The contractual fee applies when specific agreement between the client and the attorney about the fee is made. The fee can be determined as a flat fee irrespective the time devoted to the case (or costs), although generally is set as an hourly fee. The fees are paid by the client on the basis of detailed specification of all services provided by the attorney including time data.

Ordinary hourly fee is 1,500 CZK (without VAT)

However in more complicated cases, cases that involve foreign element or when legal services are provided in a foreign language the hourly fee is usually higher.

Determination of the non-contractual fee is governed by the abovementioned Barrister's Tariff . The fee is derived from the „tariff value“, i.e. the monetary value of the subject of service. The higher the „tariff value“ the higher the non-contractual attorney fee.

In determining attorneys fee in cases when the provision of legal services consists of representation in courts in civil proceedings the decisive regulation is the Decree amending Decree No. 484/2000 Coll. laying down flat rate of the remuneration for representation of a participant by an barrister or notary in resolution on the cost compensation in civil court proceedings and amending Decree of the Ministry of Justice No. 177/1996 Coll. on remuneration of barristers and compensation of barristers for providing of legal services (Barrister's Tariff), in the wording of later regulations, and repealing Decree No. 110/2004 Coll. amending Decree No. 484/2000 Coll. laying down flat rate of the remuneration for representation of a participant by an barrister or notary in resolution on the cost compensation in civil court proceedings and amending Decree of the Ministry of Justice No. 177/1996 Coll. on remuneration of barristers and compensation of barristers for providing of legal services (Barrister's Tariff), in the wording of later regulations, in the wording of Decree No. 49/2001 Coll.

When deciding upon the costs of a trial the court sets the amount to be rewarded for attorney fees based on the conditions stipulated in the abovementioned decree. Accordingly to the non-contractual fee the amount of awarded attorney costs os based on the value of the subject of the proceedings.

The amount of attorney fees awarded by the court in accordance with the decree No 484/2000 Coll. does not neccesearly exactly correspond with the non-contractual attorney fees according to Decree of the Ministry of Justice No. 177/1996 Coll.
